Introduction

This Privacy Policy governs the processing of Personal Data of independent individual users of the PingMe Service, visitors to the PingMe website, as well as the processing of Personal Data by PingMe on behalf of companies, organizations, institutions, groups of people, etc., that track time and productivity of their employees or other individuals within their PingMe account group (“Client”) within the service.

PingMe acts as a data controller, setting the purpose and means of processing the following data:

  • Personal data of users who are themselves clients of PingMe and send personal data directly to PingMe. For example, a freelancer or another individual who registers with PingMe on their own (create a PingMe Free Trial account for their own use).
  • Personal data of individuals who have subscribed to commercial communications and other news and updates from PingMe but are not registered users of the PingMe service.

PingMe acts as a data processor when PingMe processes personal data transferred by the client to PingMe.

PingMe strictly does not share any personal data of its clients to anyone or the end users of clients. The data can only be shared with the authorised person with the legal guidelines.

PingMe recommends Clients (employers) to silently install and use its services on devices in case of complete ownership of the devices or with the consent of the end-user.

Processing of Data on behalf of Clients by PingMe as Data Processor

This section applies to PingMe Clients who transfer the Personal Data of end-users of the service, such as the personal data of the Client’s employees, to PingMe. With respect to such data, the Client establishes the purpose and means of processing Personal Data; therefore, the Client is the Data Controller.

PingMe processes the Personal Data of end-users on behalf of the Client, and PingMe only gets access to the data for the purpose of providing the services; therefore, PingMe is the Data Processor.

If you, as a Data Subject, are an end-user of the PingMe Service and your profile was created by your employer, the privacy policy of the Client (for example, your employer or other organization that created your account) on behalf of which we process the data will apply. This means that any inquiries, requests, objections, or complaints that you, as a Data Subject, may have in connection with the processing of Personal Data forming part of your PingMe account must be addressed and resolved by the Client who is the Data Controller.

Details of Data Processing

  • When the Client creates accounts for end-users in its group, the Client transfers Personal Data of such end-users to PingMe. Thus, the Client instructs PingMeto process Personal Data in order to provide services to the Client in accordance with the agreement concluded between the Client and PingMe.
  • For the avoidance of doubt, this privacy policy contains the Client’s complete and final instructions to PingMe regarding the processing of personal data of end-users, and this privacy policy constitutes a binding data processing agreement.

Type of personal data and categories of Data Subjects

  • The categories of data subjects that will process their personal data on behalf of the Client include the Client’s employees, representatives, and other end-users who will be registered under the client’s group accounts. Information about these individuals may contain personal data, see paragraph 4.
  • The Client declares that it has obtained all necessary consents and/or relied on other appropriate legal bases to process the personal data of the end-users. The Client confirms that the end-users have been informed of the fact that their personal data is transferred to PingMe as a processor.

Duration of the Data Processing

  • As long as PingMe provides services to the Client and they have a valid PingMe account, PingMe will process the aforementioned data.
  • When an end-user account is deleted by the Client, PingMe processes the data of the deleted accounts in the Client’s group for the statistical and analytical interests of the Client. However, such data can be deleted at any time at the request of the Client.
  • Upon termination of the contractual relationship between PingMe and the Client, we may continue to store some Personal Data, but limited to the minimum required amount of data that may be necessary to comply with legal obligations, ensure a reliable backup system and resolve disputes between Client and PingMe, if any, to prevent fraud and abuse, to enforce compliance with PingMe agreements and / or safeguard the legitimate interests of PingMe.
  • PingMe will only share data with legal authorities as required in the event of any type of fraudulent conduct by Clients or end users.

Return and Deletion of data

  • Unless otherwise provided by applicable laws, PingMe has no obligation to store the Client’s data after terminating the agreement with the Client and deleting the Client’s account and all accounts related to it.

  • According to the Client’s choice, PingMe will delete or return all personal data to the Client after the end of the provision of services related to the processing and shall delete the existing copy, unless applicable laws require PingMe to store such personal data.

Purposes and Grounds for Processing

PingMe, as the controller, shall process your personal data in order to provide you with services, improve our services, resolve any service-related issues you may encounter, and ensure that you get the best possible customer experience.

PingMe collects and processes your personal data, including but not limited to the following purposes:

  • Register your use of the service by creating your PingMe account and providing you with the service;
    • Send you invoices and process payments for the services;
  • Personalize your use of the service when you set up your account;
  • Analyze your performance as a function of our service;
  • Communicate with you, inform you about PingMe services, and provide you with any service-related support, answer your questions, and process your requests;
  • Improve the service or develop new features in the service;
  • Analysis and measurement to understand how our services are used. For example, we will analyze the data about your use of the service to optimize product design, generate reports and create statistics about the use of PingMe services;
  • Provide you with personalized ads, promotions, and offers;

PingMe collects and processes your personal data only if we have a legal basis. Please note that we may process the same personal data at the same time for multiple purposes, and each for multiple legal basis.

Contract: In most cases, the legal basis for processing your personal data is the contractual relationship between you as the User of Service and PingMe, because we need certain information to conclude a contract and fulfill our obligations arising from this contract.

Legal Obligations: In some cases, PingMe processes personal data in accordance with legal obligations imposed on us by applicable laws, such as financial and tax reporting obligations, or if we have to respond to legal proceedings.

Information generated when using the service

Some information processed by PingMe is created by you using the service, and this information may also contain personal data. When you use the service, PingMe will record the following information:

  • IP address where you are logged in, browser type and browser software version, names of applications used, names of tasks to work on, websites visited, PingMe client version, application path, start and end times of use, time taken for breaks, screenshots of your computer screen.

When you are only an end-user and not the Client of the service, the aforementioned information is provided to PingMeby the Client (such as your employer).

Changes in Privacy Policy

  • PingMe may amend this Privacy Policy from time to time, for example, in cases where we introduce new services or new features. Amendments to this Privacy Policy are effective and applied from the moment they are uploaded to this page.
